These Terms and Conditions govern your access to and use of the Just Orders website, mobile application, and services.

1. About Just Orders

Just Orders is a technology-enabled local marketplace platform operated as a proprietorship. The platform connects customers with local vendors, service providers, vehicle rental providers, and delivery partners.

Just Orders currently operates in selected areas of Shimla, Himachal Pradesh, India. Services and availability may vary depending on the customer's location and the availability of participating vendors and service providers.

The platform currently provides access to grocery ordering and delivery, home services, and vehicle rental bookings.

2. Acceptance of These Terms

By creating an account, accessing the Just Orders website or mobile application, placing an order, making a booking, or otherwise using the services, you agree to be bound by these Terms and Conditions, our Privacy Policy, Cancellation and Refund Policy, Shipping and Delivery Policy, and any other policies published on the platform.

If you do not agree with these Terms, you must not use the Just Orders platform or its services.

We may update these Terms from time to time. Changes will become effective when the updated Terms are published on the website or application. Your continued use of the platform after an update constitutes acceptance of the revised Terms.

3. Eligibility and User Accounts

Users must create an account before using the Just Orders application and placing orders or bookings.

Account authentication may be provided through third-party authentication services, including Google OAuth through Clerk. Additional authentication methods may be introduced in the future.

You are responsible for providing accurate information during registration and for keeping your account information up to date.

You are responsible for maintaining the security of your account and for activities performed through your account. You must promptly notify Just Orders if you believe that your account has been accessed or used without authorization.

Just Orders reserves the right to suspend or terminate accounts that contain inaccurate information, are used for unlawful purposes, or violate these Terms.

4. Services Provided Through the Platform

Just Orders acts as a platform that facilitates interactions between customers and participating vendors or service providers. Depending on the service, fulfillment may be performed by a vendor, service provider, or delivery partner.

The availability of products, services, rental vehicles, delivery slots, appointment times, and other offerings may change at any time.

Information displayed on the platform, including descriptions, prices, images, availability, service areas, and estimated fulfillment times, is provided for the purpose of facilitating the customer's order or booking.

5. Grocery Orders and Delivery

Customers may use Just Orders to place grocery orders from participating local vendors.

Once an order is placed, the relevant vendor receives the order details and prepares the requested items.

Grocery deliveries are currently fulfilled using delivery partners engaged by Just Orders. The vendor provides the prepared order to the assigned delivery partner, who delivers the order to the customer.

The current expected delivery timeframe for grocery orders is generally within one day. Actual delivery times may vary because of vendor preparation time, product availability, traffic, weather, delivery-partner availability, and other circumstances outside the platform's reasonable control.

Product availability and substitutions, where applicable, may depend on the participating vendor. Customers may be contacted or notified when an ordered item is unavailable or cannot be fulfilled.

6. Home Services

Customers may use Just Orders to book participating home-service providers.

A booking may include the selected service, scheduled date, and scheduled time. The relevant service provider receives the booking information and is responsible for visiting the customer's location to perform the booked service.

Service providers are responsible for performing the services they offer in a professional manner and in accordance with the applicable description of the service.

Actual service completion may depend on the nature of the service, the customer's premises, access to the premises, materials, equipment, safety conditions, and other circumstances.

7. Vehicle Rentals

Just Orders may facilitate bookings for vehicles offered for rental by participating rental providers.

When a customer makes a rental booking, the rental amount is calculated based on the applicable rental rate and booking duration.

For example, if a vehicle is priced at ₹1,000 per day and the customer books the vehicle for three days, the rental amount is ₹3,000 before the applicable Just Orders platform fee.

Customers are currently required to provide the documents and information requested by the rental provider before receiving the vehicle. This may include a valid driving licence and Aadhaar identification, subject to applicable law and the rental provider's verification requirements.

The customer must satisfy all applicable legal and rental-provider requirements before a vehicle is handed over.

The vehicle is collected by the customer directly from the participating rental provider unless another arrangement is explicitly stated for a particular booking.

The rental provider is responsible for providing the booked vehicle and for communicating applicable vehicle-specific rental conditions, eligibility requirements, and handover requirements.

Customers are responsible for using rented vehicles lawfully and safely and for complying with applicable traffic and motor vehicle laws.

8. Platform Fees and Prices

Just Orders currently charges a 10% platform fee on applicable orders and bookings made through the platform. This platform fee is charged to the customer in addition to the price of the applicable product, service, or rental.

The 10% platform fee is calculated on the applicable order, service, or rental amount before the platform fee is added.

For example, if the underlying price of a grocery order or home service is ₹1,000, the Just Orders platform fee would be ₹100, making the total amount payable by the customer ₹1,100, before any other applicable charges or taxes.

For vehicle rentals, the platform fee is calculated on the total rental amount for the entire booking duration. For example, if a vehicle is priced at ₹1,000 per day and the customer books it for three days:

The applicable product, service, or rental price and the Just Orders platform fee will be shown to the customer before payment is completed. The customer will be able to review the total amount payable before confirming the transaction.

The platform fee is a fee charged by Just Orders for facilitating the transaction and providing the platform and related services. It is separate from the price charged by the applicable vendor, service provider, or rental provider.

Participating vendors, service providers, and rental providers may set their own prices for the products, services, or rental vehicles they offer through the platform.

Just Orders may change its platform fee in the future. Any revised fee applicable to a transaction will be disclosed to the customer before the transaction is completed.

Any applicable taxes, delivery charges, or other charges will be disclosed to the customer before payment where applicable.

9. Payments

Payments made through Just Orders may be processed using third-party payment service providers, including Razorpay.

By making a payment, you authorize the applicable payment processor to process the transaction using the payment method selected by you.

Just Orders does not store complete payment-card credentials such as full card numbers, CVV numbers, or card PINs on its own systems. Payment processing is subject to the terms, conditions, and applicable policies of the payment service provider.

A payment may be subject to additional verification or security checks by the payment provider or financial institution.

An order or booking will generally be considered confirmed only after successful payment authorization and confirmation through the platform.

10. Vendor and Service Provider Relationship

Vendors and service providers listed on Just Orders are independent providers participating on the platform. They are responsible for supplying the goods, performing the services, or providing the rental vehicles associated with their respective listings.

Just Orders may collect information and documentation from vendors and service providers as part of its onboarding, verification, operational, fraud-prevention, payment, and compliance processes.

Additional information or documentation may be requested from vendors and service providers in the future where required for payment processing, regulatory compliance, identity verification, taxation, banking, or other legitimate business purposes.

Vendor and service-provider accounts may be subject to additional terms, onboarding requirements, verification procedures, and platform rules.

Vendors and service providers are responsible for providing accurate information about themselves, their businesses, products, services, vehicles, prices, availability, and other information submitted to Just Orders.

11. Delivery Partners

Just Orders may engage delivery partners to facilitate the delivery of grocery orders and other applicable deliveries.

Delivery partners may receive information necessary to complete a delivery, including the customer's name, delivery address, contact information, and order details, subject to our Privacy Policy.

Delivery partners are expected to use customer information only for legitimate delivery and operational purposes and to comply with applicable platform requirements.

12. Cancellation Policy

Customers currently cannot cancel an order or booking after it has been placed through the Just Orders platform.

Customers should carefully review the selected products, services, rental dates, duration, quantities, delivery information, and other booking details before completing payment.

Where Just Orders or a participating vendor, service provider, or rental provider is unable to fulfill an order or booking because of a platform-side issue or another failure attributable to the platform, Just Orders may cancel the affected transaction and process an applicable refund in accordance with the Cancellation and Refund Policy.

Just Orders may introduce or modify cancellation options in the future. Any such changes will be reflected in the applicable cancellation policy or service-specific terms.

13. Refunds

Except where an order or booking cannot be fulfilled because of a platform-side issue or another circumstance for which Just Orders determines that a refund is appropriate, payments are generally non-refundable under the current cancellation policy.

Where a refund is approved, the refund will generally be processed through the payment method or payment processor used for the original transaction, subject to applicable payment-processing timelines.

The time taken for a refund to appear in the customer's account may depend on the customer's bank, card issuer, UPI provider, or other payment service provider.

Additional refund conditions may apply to specific products, services, bookings, or rental transactions where communicated to the customer before payment.

14. Customer Responsibilities

Customers agree to:

  • Provide accurate registration and order information.
  • Provide accurate delivery addresses and contact information where required.
  • Ensure that they or an authorized recipient are available to receive deliveries.
  • Provide accurate information required for home-service bookings.
  • Provide valid documents required for vehicle rental verification.
  • Use rented vehicles only in accordance with applicable laws and rental-provider requirements.
  • Not misuse, abuse, threaten, or harass vendors, service providers, delivery partners, or other users.
  • Not use the platform for fraudulent, unlawful, or unauthorized purposes.
  • Not attempt to interfere with the operation or security of the Just Orders platform.

15. Prohibited Activities

You must not use Just Orders to:

  • Commit or facilitate any unlawful activity.
  • Create fake accounts or provide false identity or business information.
  • Make fraudulent payment attempts or use payment methods without authorization.
  • Attempt to obtain goods, services, refunds, or benefits through deception.
  • Interfere with, damage, reverse engineer, or disrupt the platform.
  • Attempt to gain unauthorized access to accounts, systems, APIs, databases, or other infrastructure.
  • Upload malicious software, code, or other harmful material.
  • Use another person's account or credentials without permission.

16. Availability and Service Changes

Just Orders may add, remove, suspend, modify, or discontinue products, services, vendors, service providers, delivery areas, rental vehicles, or other platform features at any time.

We do not guarantee that any particular vendor, service, product, rental vehicle, delivery slot, or booking time will always be available.

Service availability may be affected by circumstances including weather, traffic, technical failures, vendor availability, delivery-partner availability, government restrictions, safety conditions, or other events outside our reasonable control.

17. Vendor and Third-Party Services

Just Orders may provide access to products and services supplied by independent vendors, service providers, rental providers, delivery partners, payment processors, authentication providers, and other third parties.

The respective third party may have additional terms that apply to its products or services.

While Just Orders takes reasonable steps to operate the platform and onboard participating providers, the ultimate provision of a product, service, or rental vehicle is the responsibility of the applicable provider.

18. Payment Distribution and Marketplace Transactions

Just Orders operates as a platform facilitating transactions between customers and participating vendors, service providers, rental providers, and other eligible participants.

Where payment-distribution functionality is available and approved for use with the applicable payment provider, amounts attributable to participating providers may be distributed in accordance with the applicable payment arrangement and platform fee structure.

The applicable payment provider may require vendors and other recipients to complete identity, business, banking, tax, compliance, and other verification procedures before receiving payments.

Just Orders may request additional information or documentation from vendors and service providers when required for payment processing, compliance, fraud prevention, or regulatory purposes.

19. Privacy and Personal Information

Just Orders collects and processes personal information necessary to provide the platform and its services.

Depending on the service used, this may include account information, contact information, delivery location, booking information, transaction information, and information required to facilitate vehicle rental verification.

Information may be shared with relevant vendors, service providers, delivery partners, payment processors, authentication providers, and other service providers where necessary to fulfill the requested service or operate the platform.

20. Intellectual Property

Unless otherwise stated, the Just Orders name, logo, website, mobile application, software, user interface, content, graphics, designs, and other platform materials are owned by or licensed to Just Orders.

You may use the platform only for its intended purpose. You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or otherwise exploit platform materials without prior written permission, except where permitted by applicable law.

21. Disclaimer

Just Orders provides a technology platform for facilitating orders, bookings, payments, delivery coordination, and interactions with participating providers.

Except where required by applicable law, Just Orders does not guarantee that the platform will always be uninterrupted, error free, secure, or available at all times.

Product availability, service performance, vehicle availability, delivery timing, and fulfillment may depend on independent vendors, service providers, rental providers, delivery partners, and other circumstances outside the direct control of Just Orders.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Just Orders will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from the use of the platform or services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

23. Account Suspension and Termination

Just Orders may suspend, restrict, or terminate access to an account where we reasonably believe that the user has violated these Terms, engaged in fraudulent or unlawful activity, provided false information, misused the platform, or created a security or operational risk.

We may also suspend or terminate access where required by law, payment providers, regulators, or other competent authorities.

24. Force Majeure

Just Orders will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, severe weather, traffic disruptions, government actions, internet or telecommunications failures, power failures, technical failures, strikes, civil disturbances, or other unforeseen events.

25. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable law, disputes relating to these Terms or the use of the Just Orders platform shall be subject to the jurisdiction of the competent courts having jurisdiction over Shimla, Himachal Pradesh, India.

26. Severability

If any provision of these Terms is found to be invalid, unenforceable, or unlawful, that provision shall be interpreted or modified to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

27. Entire Agreement

These Terms, together with the policies and service-specific terms referenced on the Just Orders platform, constitute the agreement between you and Just Orders regarding your use of the platform, except where additional written terms expressly apply.
